These include the content of the Vending machines, their location, the content of the producers' pages, advertisements, as well as comments. "Illegal content" any information that, in itself or in relation to an activity, including the sale of products or the provision of services, does not comply with Union law or the law of a Member State that complies with the law of the Union, whatever the precise object or nature of this right, in accordance to the Regulation on Digital Services.
"Digital Services Act" in short DSA, in French Règlement sur les Services Digital, means, Regulation (EU) 2022/2065 of the European Parliament and of Council of 19 October 2022 on a single market for digital services and amending Directive 2000/31/EC.
"Producer" means the natural or legal person who owns a business or a Horeca establishment and sells products in food vending machines.
"Seeker" means the natural or legal person who uses the services and Products offered by Yumapp SRL (for example by consulting the YUMAPP platform and using the geolocation tool) to search for data on food in vending machines or data on listed vending machines.
"Vending machine" definition Refers to a machine that allows a product to be obtained, without human intervention (self-service), after the buyer has made a choice of product and carried out a payment action (insert a coin, scan a card, press a button).
Yumapp SRL is the owner of the intellectual property or licensee of the intellectual property rights relating to the content present on the Platform, including including texts, graphics, logos, buttons, images, code, database, data and icons. Yumapp SRL is protected by proprietary rights such as copyright and by the rights of the producer of a and the various tools made available to the User. The form of the site as well as that of the application (plan, choice and layout of the topics, organizing data,...) are protected by the statutory regime of copyright. Yumapp BV prohibits the extraction and/or reuse of the all or a qualitatively or quantitatively substantial part of the content of the Platform. The Belgian Law of 31 August 1998 on the protection of legal framework for databases (transposing European Directive No. 96/9/EC) provides that infringement of these rights is punishable by penalties of up to €500,000 in fines and, in the event of a repeat offence, up to 2 years in prison. Yumapp BV expressly prohibits automated reading or copying or of all or part of the Platform (images, data, etc.) to to any end and in any manner whatsoever, and by any means techniques used (such as scraping, etc.). This includes, among other things, scraping or any other use of any content on the Platform for the purpose of training in artificial intelligence or similar technologies. The User may print a copy of the content displayed on the Platform, only for his personal use, provided that he does not alter the content in any way of the Platform and that it retains all mentions of authorship and origin of the Platform. Reproduction is therefore only authorised for the purpose of a and private copying within the meaning of the Copyright Act. Some of the names, distinctive signs and logos appearing on the Platform are trademarks or trade names owned by Yumapp SRL or their respective owners. Unless expressly and previously authorized by the owners, including SRL Yumapp, any use of the names, trademarks and logos and/or unlawful use of similar signs, is prohibited. Any copy, translation, adaptation, modification or use of any kind of all or any of the protected elements of the Platform, under any form whatsoever and by any means whatsoever, is strictly forbidden without the prior written consent of Yumapp BV. Any use The commercial exploitation of the content of the Platform is strictly prohibited. Unless expressly refused, which must not be justified, the creation of a hypertext link to the home pages of the Platform is authorized. Under no circumstances can Yumapp SRL be held liable for of visitors to the Platform from any claim or legal action brought against them by a third party who claims that the use of one of the elements of the content of the Platform, or any of the products or services offered on the Platform, infringes one of its intellectual property rights.

However, in order to protect Users, Yumapp srl has put in place various mechanisms to combat illegal content.
In particular, any element that would seem to be contrary to the legal or regulatory provisions, the good morals, or likely to offend Users and in particular: Content written in a foreign language that contains terms or descriptions unrelated to the content offered; Any Content containing terms or descriptions unrelated to the Proposed content; Any Content about a vending machine or data about it fictitious; Any Content that is fraudulent, or intended to deceive the User; Content of a political, religious or hateful nature; Any image or photograph unrelated to the proposed offer, unauthorized, counterfeit, or even pornographic;
The role of moderation teams involves: Review of reports made through the Illegal content made available to Users and Advertisers of the Platform (and any complaints); Examination of complaints made via the Internal Processing System complaints made available to Users who have reported Content as Unlawful. When moderation teams become aware of a violation of the Conditions of use, or the presence of illegal Content, the measures and The following decisions can be made: Temporary or permanent removal of the relevant Content from the Platform; Restriction of Access to the Services; Temporary Blocking or Permanent Deletion of the Custodian Account Content that is affected or deemed fraudulent. Moderation teams determine whether Content and/or account should be be subject to a restriction based on risk and severity that they represent. They may limit or remove the Content or accounts after a single serious breach of the Rules set out above or if They determine that the account has posted illegal content repeatedly. or filed several reports or complaints that were obviously unfounded.
Any User may submit a report to the Platform via the info@yumapp.be email address in order to report Content considered illegal or contrary to these Terms of Use. By using this procedure, the User undertakes to submit reports in good faith and not to misuse the reporting or complaint by making reports or calls unfounded. Yumapp SRL. reserves the right to take any action to limit or to prevent the processing of reports and to suspend or even delete accounts from individuals who are alleged to be abusing the reporting, including by submitting unfounded reports.
Users may contest the decision taken by Yumapp SRL in response for a period of 6 (six) months from the receipt of notification of the decision, by replying directly to the email from notification. These disputes are forwarded to the moderation team who will conduct a re-examination of the Content in order to confirm or not the decision.
Users may also choose to contest the decision of moderation taken by Yumapp SRL by submitting the dispute either to a body Alternative Dispute Resolution certified in accordance with the digital services, or to a court of competent jurisdiction.

The producer guarantees that any vending machine he publishes on the Platform meets quality criteria that a visitor (site or application) can reasonably wait: location and corresponding category(ies) (fruits/vegetables, bread, eggs, potatoes, prepared dishes) the description of the products offered for sale, the location and the conditions of clear and unequivocal sales. The producer expressly agrees that as soon as his Vending machine published on the Platform and paid, it waives any right to withdrawal and total or partial refund of this announcement. The SRL Yumapp reserves the unilateral right to refuse or disable before its term, and without compensation, an advertisement placed on our Platform in the following cases: An announcement about a non-existent distributor A descriptive text that is contrary to these Terms of Use. An advertisement that mentions the address of another website. An advertisement that is false, particularly in relation to its location, or an advertisement is illegal. IV. Conditions for users Buy: Yumapp SRL takes care to provide you with reliable and regularly updated data on the Platform.
